MOFCOM Announcement No.9 of 2018 on Mid-term Review Ruling on Dumping and Dumping Margin of Imports of Methyl Methacrylate Originating in Singapore, Thailand and Mitsubishi Rayon Co., Ltd., ASAHI KASEI CHEMICALS CORPORATION and Sumitomo Chemical Company, Limited from Japan

On December 1, 2015, the Ministry of Commerce of the People's Republic of China (the "MOFCOM") issued Announcement No.60 of 2015, deciding to take anti-dumping measures on imports of methyl methacrylate originating in Singapore, Thailand and Japan for five years from December 1, 2015.

On December 30, 2016, China Petroleum and Natural Gas Co., Ltd. Jilin Petrochemical Branch, Heilongjiang ZhongMeng Longxin Chemical Co., Ltd., Shandong Hongxu Chemical Co., Ltd. and Jiangsu Sierbang Petrochemical Co., Ltd. applied to the MOFCOM, claiming that after the anti-dumping measures take effect, the dumping margin of methyl methacrylate originating from Singapore, Thailand and Mitsubishi Rayon Co., Ltd., ASAHI KASEI CHEMICALS CORPORATION and Sumitomo Chemical Company, Limited from Japan to China enlarges, exceeding the rate of anti-dumping duty determined in the final ruling and therefore requesting a mid-term review with respect to the dumping and dumping margin of the anti-dumping measures applicable thereto.

In accordance with Article 49 of the Anti-dumping Regulations of the People's Republic of China and the Provisional Rules on Midterm Review of Dumping and Dumping Margin, the MOFCOM examined the qualifications of the applicants, the export prices and normal value of the underlying products and other relevant conditions.

On February 28, 2017, the MOFCOM released an announcement, deciding to conduct mid-term review with respect to the dumping and dumping margin of the anti-dumping measures applicable to the imports of methyl methacrylate originating in Singapore, Thailand and Mitsubishi Rayon Co., Ltd., ASAHI KASEI CHEMICALS CORPORATION and Sumitomo Chemical Company, Limited from Japan. This review will focus on the normal value, export price and dumping margin of imports of methyl methacrylate originating in Singapore, Thailand and Mitsubishi Rayon Co., Ltd., ASAHI KASEI CHEMICALS CORPORATION and Sumitomo Chemical Company, Limited from Japan. The Products under Investigation subject to this review are identical to those subject to the original anti-dumping measures, i.e. methyl methacrylate. The product is listed under tariff number of 29161400 in the Customs Import and Export Tariff of the People’s Republic of China. Products other than methyl methacrylate under the above tariff number fall beyond the scope of the Products under Investigation.

Pursuant to the investigation results of this mid-term review, the MOFCOM proposed to revise the related anti-dumping duties to the Customs Tariff Commission of the State Council. In accordance with Article 50 of the Anti-dumping Regulations of the People's Republic of China and the Provisional Rules on Midterm Review of Dumping and Dumping Margin of the MOFCOM, related matters are announced as follows:

I. Review ruling

After investigation, the MOFCOM ruled that there is dumping for the Products under Investigation during the review period.

II. Levy of anti-dumping duties

Pursuant to the related provisions of the Anti-dumping Regulations of the People's Republic of China, the Customs Tariff Commission of the State Council decided to, as of February 28, 2018, the anti-dumping duty rates applicable to the imports of methyl methacrylate originating in Singapore, Thailand and Mitsubishi Rayon Co., Ltd., ASAHI KASEI CHEMICALS CORPORATION and Sumitomo Chemical Company, Limited from Japan are revised as follows:

Companies of Singapore:

1. Lucite International Singapore Pte. Ltd. 10.7%
2. Sumitomo Chemical Singapore Pte Ltd 30.6%
3. All others 30.6%

Companies of Thailand:
1. THAI MMA CO., LTD. 32.6%
2. PTT Asahi Chemical Company Limited 32.6%
3. All others 32.6%

Japanese companies:

1. Mitsubishi Rayon Co., Ltd. 34.8%
2. ASAHI KASEI CHEMICALS CORPORATION 34.8%
3. Sumitomo Chemical Company, Limited 34.8%

Other Japanese companies apply the tax rates set forth in the MOFCOM Announcement No.60 of 2015.

III. Methods of levying anti-dumping duties

As of February 28, 2018, import operators shall pay relevant anti-dumping duties to the Customs of the People’s Republic of China when importing the Products under Investigation. The anti-dumping duties shall be levied by means of ad valorem on the basis of dutiable value authorized by China Customs, and the formula is: anti-dumping duties = dutiable value authorized by China Customs * rate of anti-dumping duties. The import value-added tax shall be levied by means of ad valorem with the dutiable value authorized by China Customs plus the tariff and anti-dumping duties as the taxable value.

IV. Administrative reconsideration and administrative litigation

Any person who refuses to accept the review may, according to Article 53 of the Anti-dumping Regulations of the People's Republic of China, apply for an administrative reconsideration or initiate litigation to the people's court according to the law.

V. MOFCOM Announcement No.9 of 2018 on Mid-term Review Ruling on Dumping and Dumping Margin of Imports of Methyl Methacrylate Originating in Singapore, Thailand and Mitsubishi Rayon Co., Ltd., ASAHI KASEI CHEMICALS CORPORATION and Sumitomo Chemical Company, Limited from Japan will take effect as of February 28, 2018.
